If bankruptcy has been filed on a person who owns a property, does that erase all liens on that property? This is Dave at TitleSearch.com. Bankruptcy may not erase all liens on a piece of real estate. There's some liens that stay accrued to a property regardless of the bankruptcy of the owner. Sometimes it may be a Homeowner Association encumbrance, sometimes government liens, tax liens, remain on that property and endure a bankruptcy. These aren't things that are, even if they're unsecured or technically unsecured, they may not be raced by a bankruptcy or even a foreclosure on a property. It's really good to get good legal advice and have them take a look at the current title search of a property so that you know if you're purchasing a piece of real estate and the prior owner went through a bankruptcy, that you're not just taking it at face value... that everything in that bankruptcy or everything that that owner had is you raced from that parcel.
