What is a lis pendens on real estate? This is Dave at TitleSearch.com. A lis pendens is a Latin phrase. It actually stands for litigation pending. It's a way for a lien holder or a lender to make a placeholder on the title records for an upcoming court event. Let's say there's a mortgage that's in default, the lender wants to foreclose, but they don't have all the paperwork ready yet or they want to put together a foreclosure package, They can file a lis pendens saying, Look, there's something going on in this property. We don't have all the paperwork filed yet, but here is a date and time in place for this lien basically to be put on the property. Then they can have some other time to put all together the foreclosure process. But in the meantime, the priority of that filing is maintained by the date of that liz pendence. It also puts the public on notice, potential buyers or anybody else, that there may be something going on with that property. This can happen for any type of lien, a mechanics lien, child support lien can be evidenced and retained by a lis pendens.
