Mechanics liens are an excellent way for contractors to protect their interest on a property, but real estate owners also need to be protected from mechanics liens which may not be able to be filed. This is Dave at TitleSearch.com. In Pennsylvania, a union, presumably representing contractors, filed a mechanics lien or filed a court case to place a mechanics lien on a property. And very recently, the Supreme Court in that state ruled that that benefit fund didn't have standing to file that mechanics lien. So even though mechanics lien have very wide latitude on protecting contractors on a property, there are limitations where the correct filer -the correct creditor -has to be the one who files that lien against a property. This, again, protects property owners from liens landing on their property that may not be correct.
