How are zoning records able to affect a property title? This is Dave at TitleSearch.com. It's possible that a property that's going through a zoning process or has had some zoning variants, that will result in a claim or a cloud against a title. Sometimes these are very obscure. It may have happened a long time ago in history when the property was developed or when an easement was placed. These zoning records, for some title search clients, are important claims against a property that need to be known about. In some very rare instances, a zoning record can create a lien on a property. For example, if the zoning record requires a certain action to be taken and it has a penalty specified if it's not, that can create a lien or an expense which results in a cloud on title. A good example, if there's a special assessment for things like sewer, or water, or some other improvement of the community, that may show up in zoning records and therefore can affect title.
